WHAT IS THE FARM BILL?
On December 20, 2018, President Donald J. Trump signed the 2018 Agricultural Improvement Act, also known as the 2018 Farm Act. This act contained language specifically inserted by Senate majority leader Mitch McConnell (KY) , which completely legalized industrial hemp and ended almost 80 years of ban at the factory. Hemp is now completely exempt from the definition of the controlled substance act (CSA).
In addition, the World Health Organization and the World Anti-Doping Agency have made public statements that CBD is safe and non-addictive and have removed it from the list of prohibited substances. In addition, the 2018 Farm Bill clarified the definition of hemp – usually limited to fiber and seeds – to include the entire plant, specifically the floral parts and cannabinoids derived from it. This set in motion the legal framework for the already growing market for hemp and CBD extracts.
Industrial hemp is the genetically distinct, non-psychoactive variety, low in THC and cannabis sativa in the plant. Hemp has absolutely no use as a recreational drug. The Farm Bill defines industrial hemp as “the Cannabis sativa L. plant and any part of that plant, whether or not it grows, with a concentration of delta-9 tetrahydrocannabinol not exceeding 0.3% in dry weight”.
